								<content:encoded><![CDATA[<p>Gov. John Bel Edwards has signed into law new limits on drone use in Louisiana.</p>
<p>A bill by Rep. Stephen Dwight, a Republican from Lake Charles, will restrict drone use near schools, school property or correctional facilities. It includes exceptions for police, situations where the landowner grants permission and for pre-agreed recordings like sporting events.  The law takes effect Aug. 1.</p>
<p>A second bill approved by Edwards will cover drones under criminal trespassing laws. The measure by Sen. Dan Claitor, a Baton Rouge Republican, makes an exception for anyone flying the unmanned aircraft system for commercial agricultural use. It takes effect immediately.</p>
<p>The governor&#8217;s office announced this week that Edwards had signed the measures.</p>

<p>So its now illegal to fly over private property without permission. Thats now trespassing. It will be interesting to see if this part stands up because the FAA regulates airspace and aircraft can not be charged with trespassing. Long standing law states that you dont own the rights to the air over your property. </p>
<p>The state really doesn&#8217;t have the rights to pass such a  law we will see how it stands up and who wants to challenge it. We need a drone group to sue the state over this.</p>

<p><span style="font-size: small;">Unauthorized UAS or drone operations may prevent other aircraft from performing life-saving missions and increase the risk of mid-air collision. Anyone, including hobbyist or recreational fliers, who interferes with disaster response efforts is subject to civil penalties of up to $32,140 per violation and possible criminal prosecution. </span></p>
<p><span style="font-size: small;"> </span></p>
<p><span style="font-size: small;">Unmanned aircraft system (UAS) or drone operators are responsible for checking applicable flight restrictions before operating and must not interfere with any aircraft assisting in hurricane disaster response operations, regardless if there is a flight restriction in place or not. </span></p>

<p><span style="font-size: small;">UAS or drone operators supporting disaster response operations <u>must</u><u> be approved</u> by the Federal Aviation Administration (FAA) prior to operating. Operators may seek approval by following these steps:</span></p>

<li><span style="font-size: small;">The operator must secure support from a governmental entity, and the operation must directly contribute to the response, relief, or recovery effort.</span></li>
<li><span style="font-size: small;">After completing step 1, the operator must contact the FAA’s Systems Operations Support Center (SOSC) at <a href="tel:202-267-8276">202-267-8276</a>for assistance.</span></li>

<p>The law will restrict drone use near schools, school property or correctional facilities. It includes exceptions for police, situations where the landowner grants permission and for pre-agreed recordings like sporting events.</p>
<p>The law takes effect Aug. 1.</p>
<p>The second law introduced by Sen. Dan Claitor, a Baton Rouge Republican, </p>
<p>The law covers drones under criminal trespassing laws. The measure makes an exception for anyone flying the unmanned aircraft system for commercial agricultural use. It takes effect immediately.</p>
<p>Basically the second law makes it illegal to fly over anyone&#8217;s property. Since LA law no longer requires posted or no trespass signs to be trespassing. </p>
<p>So its only legal to fly if its legal for you to walk on the land.</p>
<p>But if you have a farm and are doing anything related to commercial agricultural then you can fly over neighbors land. Strange hu?<br />
The second is likely to be modified because people are using drones to find cows. I would not be surprised to see lost farm animals added to the exempt list later on. </p>
